TERMS AND CONDITIONS

 

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. The promoter is Ceva Animal Health Pty Ltd (ABN 54 002 692 426) of 11 Moores Road, Glenorie NSW 2157 (“Promoter”).
  3. Promotion commences on 3 November 2014 and ends at close of business on 30 January 2015 (“Promotional Period”).
  4. Entry is only open to Australian veterinary clinics (“Eligible Clinics”).
  5. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Clinics and reserves the right, in its sole discretion, to disqualify any Eligible Clinic whose authorised representative(s), employee(s) and/or owner, the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of thepromotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  6. To enter, an authorised representative of an Eligible Clinic (“Authorised Representative”) must complete the following steps: (a)   purchase a minimum of seven (7) 45cm or 70cm Adaptil Collars in a single transaction from their CEVA sales representative (i.e. take up the ‘buy  7 Adaptil Collars and get 1 free’ offer available from their CEVA sales representative); (b)   sell 45cm and/or 70cm Adaptil Collars during the Promotional Period at their Eligible Clinic; and (c)    provide the relevant sales report/s (showing the 45cm or 70cm Adaptil Collars sold during the Promotional Period) to their CEVe a mA sales representative by 5pm (local time) on 6 February 2015. The CEVA sales representative and the Promoter will determine the format of sales data, which will be acceptable and eligible for this promotion.
  7. In the event sales report/s are not provided in the format deemed acceptable by the CEVA sales representative and/or the Promoter; and/or the sales report/s provided to a CEVA sales representative is forged/manipulated/incorrect (as determined by the Promoter), the Promoter may in its absolute discretion deem the Eligible Clinic not eligible for a prize in this promotion. Furthermore, the Promoter and/or CEVA sales representative may require Eligible Clinics to provide further proof of any sales (e.g. receipts, invoices, bank/credit card statements, etc), as determined by the Promoter in its absolute discretion, to verify any sales data provided. In the event that proof of sales provided does not satisfy the Promoter as to the validity of the sales report/s, the Promoter may determine the Eligible Clinic not eligible for a prize.
  8. The winning Eligible Clinics will be notified by telephone.
  9. This is a game of skill and chance plays no part in determining the winners. 
  10. The Promoter’s decision is final and no correspondence will be entered into.
  11. A total of five (5) prizes will be awarded for this promotion; one (1) prize in each of the following five (5) State/Territory groups: (1) NSW/ACT; (2) VIC/TAS; (3) NT/SA; (4) WA; and (5) QLD (“State Groups”). The Eligible Clinic that sells the highest number of 45cm and/or 70cm Adaptil Collars combined during the Promotional Period (based on sales report data provided in accordance with the entry instructions) in their respective State Group will win a $500 Red Balloon voucher.
  12. The prize will be awarded to the owner of each respective winning Eligible Clinic.
  13. Tie-Break Mechanic: In the event that two (2) or more Eligible Clinics are tied with the same highest number of 45cm and/or 70cm Adaptil Collar sales during the Promotional Period for their State Group; the Promoter will compare purchase data of the tied Eligible Clinics from their CEVA sales representative in the full month prior to the Promotional Period (i.e. in October 2014); and award the prize to the tied Eligible Clinic which purchased the most total amount (in dollars) of products from their CEVA sales representative within that month. In the event there is still a tie, the Promoter will compare the purchase data in the next month prior and this process will continue until a winner is determined for that respective State Group. In the event there is still a tie, the Promoter will implement another skill based tie-break mechanic, as determined by the Promoter in its absolute discretion, to determine one (1) outright winner for each State Group.
  14. Any ancillary costs associated with redeeming a voucher are not included. Any unused balance of a voucher will not be awarded as cash. Redemption of a voucher is subject to any terms and conditions of the issuer including those specified on the voucher. 
  15. If for any reason a winner does not take or redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  16. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
  17. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  18. Authorised Representatives consent to the Promoter using their name, likeness, image and/or voice in the event their Eligible Clinic is a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  19. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Clinic; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  21. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner, Authorised Representative or Eligible Clinic; or (f) use of a prize.
  22. As a condition of accepting a prize, a winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  23. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.ceva.com.au.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Authorised Representative/Eligible Clinic. The Privacy Policy also contains information about how Authorised Representatives/Eligible Clinics may opt out, access, update or correct their PI, how Authorised Representatives/Eligible Clinics may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose an Authorised Representative/Eligible Clinic’s personal information to any entity outside of Australia.
